01 Who we are & agreement to terms

PropGym ("PropGym," "we," "us") is an educational trading-practice platform operated by an individual sole proprietor. These Terms of Service ("Terms") form a binding agreement between you and PropGym governing your use of the website at propgym.com and related services (the "Service").

By creating an account or using the Service, you confirm you have read, understood, and agree to these Terms and our Privacy Policy and Risk Disclaimer. If you do not agree, do not use the Service.

02 Eligibility

You must be at least 18 years old and able to form a binding contract to use PropGym. By using the Service, you represent that you meet these requirements. The Service is intended for personal, educational use.

03 What PropGym is — and is not

PropGym provides simulated trading scenarios, practice tools, and AI-generated coaching for educational purposes. PropGym is not financial, investment, or trading advice, is not a brokerage, and does not guarantee any outcome, including passing any funded evaluation or achieving profitability. We are not affiliated with any proprietary trading firm or evaluation provider. Please read the Risk Disclaimer in full — it is part of these Terms.

04 Your account

You're responsible for keeping your login credentials secure and for all activity under your account. Provide accurate information when you sign up. Notify us promptly at propgymsupport@gmail.com if you suspect unauthorized use. You may not share your account or let others use it.

05 Subscriptions, billing & cancellation

Free and Pro tiers

PropGym offers a free tier with limited access and a paid "Pro" subscription that unlocks additional features. Current pricing is shown on the site and may change with notice for future billing periods.

Billing

Pro is billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us (via Stripe) to charge your payment method each billing period until you cancel. You're responsible for any taxes that apply.

Cancellation

You can cancel anytime from your account settings or the billing portal. When you cancel, your subscription remains active until the end of the current paid billing period, and you keep Pro access until then. After that, your account reverts to the free tier. We do not provide partial or prorated refunds for the unused portion of a billing period unless required by law.

Refunds

Except where required by law, payments are non-refundable. If you believe you were charged in error, contact propgymsupport@gmail.com and we'll review it in good faith.

Failed payments

If a renewal payment fails, we may retry it and may suspend or downgrade Pro access until payment succeeds.

06 Acceptable use

You agree not to:

• Use the Service for anything unlawful, or in violation of these Terms;
• Attempt to disrupt, overload, reverse-engineer, scrape, or gain unauthorized access to the Service or its systems;
• Abuse, automate, or attempt to inflate usage of the AI coaching or other metered features;
• Resell, redistribute, or commercially exploit the Service or its content without permission;
• Misrepresent your identity or use another person's account.

We may suspend or terminate accounts that violate these rules.

07 Intellectual property

The Service, including its software, design, text, scenarios, and branding, is owned by PropGym and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended educational purpose. You retain ownership of the data and inputs you provide; you grant us the rights needed to operate the Service (for example, to process and store your practice data so the platform works).

08 Third-party services

PropGym relies on third parties to operate, including Stripe (payments), Supabase (authentication and data), Anthropic (AI), and hosting providers. Your use of the Service may be subject to those providers' terms. We are not responsible for third-party services, and their availability is outside our control.

09 Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any result will be achieved. Your use of the Service is at your own risk.

10 Limitation of liability

To the maximum extent permitted by law, PropGym and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, trading losses, evaluation fees, or goodwill, arising out of or related to your use of the Service — even if we've been advised of the possibility.

To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the three (3) months before the claim, or USD $50.

Some jurisdictions don't allow certain limitations, so some of the above may not apply to you.

11 Indemnification

You agree to indemnify and hold harmless PropGym and its operator from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your trading or financial decisions, or your violation of these Terms or any law.

12 Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.

13 Changes to these terms

We may update these Terms from time to time. If we make material changes, we'll update the "last updated" date and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

14 Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws rules, except where your local consumer-protection laws require otherwise. (Confirm the correct governing-law and dispute-resolution choice with a licensed attorney before relying on this section.)
